The families of victims killed in the 1998 crash of Swissair Flight 111 off Nova Scotia will not receive punitive damages according to a Federal judge's ruling. U.S. District Judge James T. Giles dismissed several hundred claims after determining that the crash is covered by the Death on the High Seas Act of 1920, which limits family members who relied on the deceased for income to only compensatory damages.
The plaintiffs argued that the High Seas Act did not pertain to the case because the plane crashed in Canadian waters. Giles, however, said the act has been applied in several other cases involving accidents in a foreign country's waters.
