A Federal judge recently ruled that a Florida woman may sue her HMO over allegations that one of its agents lied to her about which physician she could see. In August 2000, while Linda Flower was searching for a new Medicare HMO plan, Humana Inc. agent Bill Torres promised that she could continue using Dr. William Sheremata, a renowned neurologist treating Flower for multiple sclerosis, if she switched coverages. Months later, however, when she tried to get treatment from Sheremata, Flower was told the doctor was not covered under Humana's Gold Plus Plan. The company claimed the physician was not in Flower's service area. She was forced to pay for treatment herself.
In a complaint filed in January, Flower alleged Humana committed fraud, causing her emotional distress.
