A Harris County, Texas jury recently awarded more than $5 million to the family of a 9-year-old boy who drowned during a canoe excursion. Sam Schubert was a camper at Camp Ozark in Mount Ida, Arkansas in July 2000 when he and several other children and counselors went canoeing down the Ouachita River. During the trip, Schubert's canoe overturned and became pinned against a tree. Unable to free himself, the boy went without oxygen for nearly 12 minutes. Although counselors trained in CPR eventually resuscitated him, Schubert died from post-anoxic demyelination six weeks later.
Plaintiff attorneys argued that because several campers had become stuck against the same tree a week before Schubert's accident, counselors and camp officials should have made more adequate strides to prevent a reoccurrence. Camp counselors also reportedly lacked proper training in canoe operation. The jury found the camp and its owner negligent.
