Rite Aid Corporation must pay $850,000 to the family of a woman who died shortly after receiving a misfilled prescription at the company's Andalusia, Alabama store. Jewell Deal, 78, died of a heart attack in 1999, one month after Rite Aid filled a prescription for double her doctor-recommended dosage of the blood pressure medication Lopressor.
An expert witness called by the plaintiff's attorney argued that the excess Lopressor, 100 mg tablets instead of 50 mg, contributed to Deal's congestive heart failure. Defense attorneys claimed Deal's long history of heart problems led to her fatal heart attack. A spokesperson for the Alabama Pharmacy Association admitted that a "shortage of pharmacists" existed in the state, which may have played a role in the prescription error.
