Family Sues Disney After Accident

May 22, 2001

The family of a four-year-old boy injured while on the Roger Rabbit Car Toon Spin at Disneyland has sued the park for damages arising from the September 22, 2000 accident. The lawsuit alleges that Disneyland was, among other things, negligent in its operation of the ride, and as a consequence, four year-old Brandon Zucker was severely injured.

The family filed the lawsuit soon after the California division of Occupational Safety and Health issued a report on the incident. The report cited the park for placing the boy improperly in the ride and failing to put the lap bar down. The agency called for major safety changes in the Car Toon Spin ride before it can reopen.

The boy fell out of the car, becoming trapped underneath the following car. The ride dragged him several feet before stopping. His oxygen supply was cut off for several minutes, resulting in severe brain damage and extensive physical injuries including a broken pelvis, internal bleeding, and loss of sight.

Disney officials issued statements indicating that they support the family and are praying for the little boy's recovery but denied any negligence.

Recently, Disney Land settled a multi-million dollar lawsuit filed by the family of a man killed in 1998 while on the Columbia Space Ride. As a result of that incident, the California legislature enacted laws requiring amusement parks to report all injuries and to undergo annual inspections.
