A tort reform bill aimed at limiting malpractice awards will go before the House floor next week after a second committee approved the legislation. The House Energy and Commerce Committee gave final approval to the bill Thursday, much to the dismay of House Democrats who say caps on medical liability awards are unfair to victims of malpractice. The Energy and Commerce Committee's endorsement came one day after the House Judiciary Committee approved the bill with a voice vote.
The legislation would cap pain and suffering awards at $250,000 and limit punitive damages to twice the amount of economic damages. The bill would also limit attorney's fees and the statute of limitations on filing lawsuits. Democrats unsuccessfully attempted to amend the bill but said they would continue to fight any tort reform legislation.
