Rape Suit Can Proceed Against Casino

A Court of Appeals has ruled that a civil suit against the Stateline Casino in Nevada can proceed. The suit stems from the 1995 rape of an intoxicated female guest. The woman, her husband and some friends went to the casino in April 1995. She drank complimentary mixed drinks, tequila shots, champagne and wine. She met a man while playing craps and chatted with him throughout the evening.

The intoxicated woman later became confrontational and was taken to a casino security office. She was so drunk that the security officers were unable to get any information from her other than her first name. The man she met earlier informed security guards that they were together and they should drop the woman off in his hotel room. The security guards, without confirming the man's claims, dropped her off at his room in a nearby hotel. The man, identified as Jay Owens, later raped the woman. He has since pled guilty to forcible sexual abuse charges and was sentenced to a 90-day prison term.
