Lawyers are preparing to file the first class action lawsuit against Bayer regarding the company's cholesterol-lowering drug Baycol. The drug is linked to at least 52 deaths worldwide. Additionally, the family of an Oklahoma man who died of kidney failure as a result of taking Baycol is suing Bayer. A Florida woman also filed suit claiming the drug caused a variety of medical problems, including muscle degeneration.
The law firm preparing the class action suit expects that Baycol litigation will cost Bayer at least $3 billion. The lawsuit requests that Bayer establish a fund to monitor the development of side effects from the drug. The suit will also seek damages for the medical problems and deaths caused by Baycol.
The claim filed by the Oklahoma family alleges that Baycol is a defective and unreasonably dangerous product. It also blames the company for providing inadequate warnings of Baycol's potential dangers and for holding back information from the public regarding injuries and deaths associated with Baycol.
Lawyers for a Tallahassee, Florida woman also filed suit this week. The suit claims Baycol caused chronic fatigue, muscle degeneration and numerous other medical problems, even after the woman stopped taking the drug.
Bayer AG recalled Baycol after receiving reports that it caused myositis and rhabdomyolysis, potentially fatal muscle and kidney disorders.
