A New York woman won her eleven-year battle against her neurosurgeon last month when a jury awarded her $1.75 million in an eye surgery malpractice case. Dawn Montagna was 12 when she was diagnosed with fibrous dysplasia, an abnormal growth that appeared around her right orbit. Dr. Edwin Chang, the defendant, met with Montagna in 1990 and told the plaintiff he would remove the growth as well as operate near the optic nerve to prevent any future eye problems. The optic nerve was undamaged before the surgery.
During the operation, Dr. Chang injured the optic nerve and Montagna was left blind in her right eye. Montagna sued Dr. Chang for negligence for continuing the surgery into the undamaged optic nerve and not properly monitoring the nerve during the procedure.
