Sadly, kernicterus, a condition that had been virtually eradicated in the U.S. by the 1970's, is reemerging. Jaundice, the cause of kernicterus, is widely known and supported by volumes of literature. The re-emergence of kernicterus is attributed to early discharge of newborns; the limitations of visual assessment of jaundice; the lack of concern about jaundice among pediatricians, neonatologists, and nurses; and the misinterpretations of practice parameters designed to protect newborns.
Cost-cutting efforts have eliminated many important laboratory tests. Testing to protect against kernicterus typically costs less than $30. If your newborn exhibits signs of jaundice, such as yellowish skin and eyes or dark urine, you should demand that such a test be conducted.
If your newborn suffered from jaundice, kernicterus or other conditions and your doctor failed to diagnose or treat the conditions, it may be important for you to contact an attorney who can help you protect your child's legal rights. Please keep in mind that there may be time limits within which you must commence suit.
