According to Section 3(a)(1) of the Consumer Product Safety Act, an amusement ride is described as:

"...any mechanical device which carries or conveys passengers along, around, or over a fixed or restricted route within a defined area for the purpose of giving its passengers amusement, which is customarily controlled or directed by an individual who is employed for that purpose and who is not a consumer with respect to that device, and which is not permanently fixed to a site."

Consumer Products Safety Commission (CPSC) statistics show that roller coasters and whirling rides cause the most injuries requiring hospitalization. In 1999, 10,400 injuries resulting from amusement park rides required a hospital emergency room visit. In addition, a National Institutes of Health study found that extreme roller coasters caused over one dozen cases of bleeding in the brain during the last decade. Speed, twists and turns are the leading causes of such injuries. The CPSC investigation also determined that mechanical failure, operator behavior, and consumer behavior play a role in amusement park accidents.

Amusement parks, theme parks, and carnivals are a wonderful part of American life. Unfortunately, some park operators compromise safety in an effort to increase profits.
